Terms of Use and Shipping

1. General Overview:

Figime’s terms of use (these terms, referred to as “terms”) are a legally binding agreement (but it’s really not as scary as it sounds!) between Figime and you, which governs your use of our products, content and online services available on our website: www.figime.com, altogether referred to as the “service”. By using and accessing our service you agree to act in accordance with and to be bound by these terms.


2. Use of Service:

a. Content:

This service covers a diverse range of materials which are related to Figime’s products and services, this includes content creator merchandise, content creator avatar and persona figures, and other products and services (collectively referred to as “content”). All the rights, titles and interest in the service and content belongs to Figime and our licensors, of which all are protected by intellectual property laws.

 

b. Limited License:

Figime grants you a limited, non-transferable and non-exclusive license to view, access and interact with the content only for your own personal and non-commercial use. Thereby, this license does not entitle you to any intellectual property rights or ownership of the content.

 

c. Accounts:

Some of the features of the service could require the creation of an account. During registration you agree to provide current and accurate information, notify us of unauthorized use and maintain the security of your own account. You are responsible for all actions performed under your own account.

 

d. Restrictions:

In order to use the service you must be above thirteen years old, and agree to never use our service for harmful or unlawful purposes, violate our or associated intellectual property rights, violate any relevant laws, or in any way reverse engineer the service.

 

e. Availability:

Without notice or liability we reserve the full right to terminate or suspend the availability of the service in full or in part, at our own discretion. Following termination or suspension your rights and obligations under these terms will immediately cease.

 

3. Purchases and Products:

Parts of the service might require a payment for t-shirts and other merchandise, content creator avatar figures and other related products (referred to as “products”, including but is not limited to products such as t-shirts, cups, figures and other related products). Please read our terms and conditions and policies for payment methods, purchases, refunds and shipping.


4. Shipping:

a. Tracking and Notifications: Please check the descriptions on each campaign page for shipping progression.

b. Returns and Exchanges, Lost or Damaged Items: All purchases from successful campaigns (when the minimum goal is reached) are non-refundable, and not entitled to any returns. Please refer to the terms and conditions for more information regarding returns, exchanges, and refunds.

c. Shipping Time: Transit and order processing times are estimated when a package departs from the manufacturer. Check descriptions on each campaign page for shipping progression. Estimated delivery times: delivery dates can vary depending on your region and season, but generally, shipping to the US takes 15-25 business days (shipped after campaign goal is met). Shipping to other destinations may vary. There may be potential delays during holidays or high-demand periods.

d. Shipping Cost: Shipment may incur additional customs charges, import duty, and taxes, these differ by region and are the responsibility of the customer. Shipments outside of the US may incur additional customs charges. Additionally, orders to countries other than the US will be subject to different and varying local import duty and taxes. You will find the final tax after entering your address in the order checkout. A flat USD $5.99 standard shipping for all USA addresses, shipping costs to other destinations as well as express shipping may vary and will be displayed in the order checkout.

e. Other: Our shipping policies may be subject to change and provide a date of the last update. We are not to be held liable for delays which are not due to external causes (e.g., carrier delays, weather conditions, natural disasters, customs delays).


5. Customer Support:

In case of any questions please get in touch with us through our customer support. Our customer support can offer assistance, by reaching out to us through different means you give your consent to receive electronic communications from us.



6. Third-Party Services:

Our service usually includes links to third-party web pages or services. We do not operate these, and are thereby not responsible for what they offer or their content. Interacting with these third-party services is your own responsibility and at your own risk.


7. Disclaimer of Warranties and Liability:

Our service is provided “as available” and “as is”. We make no warranty regarding the accuracy of the content, its fitness or reliability for a given purpose. As far as permitted by law, Figime and all its’ affiliates and third-party collaborators are not liable for any damages that could arise from your use of our service.


8. Indemnification:

You agree hereby to hold and indemnify Figime harmless from any liabilities, claims or losses that can arise from your breach of any applicable laws and these terms.


9. Modification of Terms:

Figime reserves the right to modify these terms at any given time. Changes will be effective following posting them on the service. Your continued use implies the acceptance of the modified terms.


10. Returns, Exchanges, and Refunds:

All purchases from successful campaigns (when the minimum goal is reached) are non-refundable, and not entitled to any returns. Until the minimum goal is reached you can receive a full refund, after the minimum goal is reached you will not be able to get a refund from Figime. In the case of campaigns that do not reach the minimum goal (non-successful campaigns) you will receive a complete refund (taxes and shipping that were paid by you included) to the payment method you used. We are not to be held liable for delays which are not due to external causes (e.g., carrier delays, weather conditions, natural disasters, customs delays).


11. Quality Assurance:

In case of a damaged product you can receive a new one free of charge at the next earliest shipping cycle. Contact us within 5 working days to get a new product.


12. General Provisions:

These terms constitute the entire agreement between you and Figime. In case of any provision deemed as unenforceable, it will not affect the remaining provisions’ validity. These terms are governed by the laws of Norway, the European Union and the Unites States of America, and any disputes will be subject to the exclusive jurisdiction of these courts.

We do not ship to your region? Contact us, we may be able to arrange a package at a custom price. As per today we do not ship to all countries. Product shipping destinations are set on a case by case basis, please access the respective product page to see which countries a product will ship to.
